Agreement to Terms
By opting in to receive SMS/text messages from Brambleberry ("Brambleberry," "we," "us," or "our"), you agree to these SMS Terms and Conditions ("Terms"). Please read these Terms carefully before subscribing to our SMS program.
These Terms are a legally binding agreement between you and Brambleberry. If you do not agree to these Terms, do not opt in to our SMS program.

You understand and agree that:
- Text messages may be sent using an automatic telephone dialing system or other automated technology
- Your consent is not required as a condition of purchasing any goods or services from Brambleberry
- Message and data rates may apply depending on your wireless carrier and plan
- You may revoke your consent at any time by following the opt-out instructions below
CONSENT IS NOT A CONDITION OF PURCHASE

Carriers are not liable for delayed or undelivered messages.
How to Opt Out
You may opt out of Brambleberry SMS Alerts at any time by using any of the following methods:

- UNSUBSCRIBE
- QUIT

After You Opt Out
After you text STOP or otherwise opt out:
- You will receive one (1) confirmation message acknowledging your opt-out
- Your request will be processed within 10 business days
- You will no longer receive marketing text messages from Brambleberry
- You may continue to receive transactional messages related to existing orders as permitted by law
- Opting out of SMS does not affect your email subscription or Brambleberry account

If you opt out and wish to re-subscribe later, you may:

Message Timing
Brambleberry respects your time. We send text messages only between 8:00 AM and 8:00 PM in your local time zone.
We determine your time zone based on your phone number's area code or your account information.
Cart Abandonment Messages
If you add items to your shopping cart on brambleberry.com but do not complete your purchase within one (1) hour, you may receive a cart reminder text message.
These reminders are part of the Brambleberry SMS Alerts program. You can opt out of all messages, including cart reminders, by texting STOP at any time.
Privacy

BRAMBLEBERRY IS NOT RESPONSIBLE FOR:
- Delays or failures in message delivery due to carrier networks
- Technical malfunctions of wireless networks or devices
- Charges imposed by your wireless carrier
- Any damages resulting from your participation in the program
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BRAMBLEBERRY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN THE SMS PROGRAM.
IN NO EVENT SHALL BRAMBLEBERRY'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO BRAMBLEBERRY, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Indemnification
You agree to indemnify, defend, and hold harmless Brambleberry and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your violation of these Terms
- Your violation of any applicable laws or regulations
- Your provision of inaccurate information
- Any unauthorized use of your mobile device
Modifications to Terms
Brambleberry reserves the right to modify these Terms at any time. If we make material changes that affect your rights:
- We will notify you by text message before the changes take effect
- Your continued participation in the SMS program after notification constitutes acceptance of the modified Terms
- If you do not agree to the modified Terms, you may opt out at any time
The "Last Updated" date at the top of these Terms indicates when they were most recently revised.
Modifications to the Program
Brambleberry reserves the right to modify, suspend, or discontinue the SMS program (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the program.
Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.
Informal Resolution
Before initiating any formal dispute resolution, you agree to contact us at [email protected] to attempt to resolve any dispute informally. We will attempt to resolve the dispute within 30 days.
Jurisdiction
Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Whatcom County, Washington. You consent to the personal jurisdiction of such courts.
Class Action Waiver
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Entire Agreement
These Terms, together with our SMS Privacy Policy, constitute the entire agreement between you and Brambleberry regarding the SMS program and supersede all prior agreements and understandings.
